Digital Millennium Copyright Act (“DMCA”) Policy
TheCowboyChannel.plus (“TheCowboyChannel.plus”, “we”, “us”, or “our”) respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable law, it is our policy to respond promptly to notices of alleged copyright infringement on the website TheCowboyChannel.plus (the “Site”).
Upon receipt of a valid DMCA notice, TheCowboyChannel.plus will, in its sole discretion and as appropriate, remove or disable access to material claimed to be infringing and/or terminate access to the Site for users who are repeat infringers of copyright-protected content.
How to Submit a DMCA Takedown Notice
If you believe that your copyrighted work or other intellectual property has been copied, posted, or otherwise used on the Site in a way that constitutes infringement, please send a written DMCA notice to our Designated Copyright Agent that includes all of the following:
- Identification of the copyrighted work or other intellectual property that you claim has been infringed.

- Your contact information, including your full name, mailing address, telephone number, and email address. If different, please also provide an email address where the alleged infringing party (if not TheCowboyChannel.plus) may contact you.
- A statement of good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on behalf of the owner.
- Your electronic or physical signature (for example, typing your full legal name at the end of the notice).

TheCowboyChannel.plus may request additional information from you if necessary to process your notice. If we remove or disable access to the allegedly infringing material, we will make a reasonable attempt to notify the user who posted the material that it has been removed or disabled. We may also provide that user with a copy of your notice, including your contact information, so that they may contact you directly and/or submit a counter-notification.
Counter-Notification
If you believe that material you posted to the Site was removed or disabled as a result of mistake or misidentification, you may send us a written counter-notification. To be effective, a counter-notification must include:
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled (for example, the specific URL).
- Your full name, mailing address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside of the United States, that you consent to jurisdiction in any judicial district in which TheCowboyChannel.plus may be found), and that you will accept service of process from the person who provided the original DMCA notice or that person’s agent.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your physical or electronic signature (for example, typing your full legal name at the end of the counter-notification).
Upon receipt of a valid counter-notification, we may restore the material in accordance with the DMCA, unless our Designated Copyright Agent first receives notice that the original complainant has filed a court action seeking an order to keep the material removed.
Misrepresentations
Please note that, under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider.
